Show OIL OFFICIAL GIVES OF VIEW readers of the times independent will be interested in the following communication from amian W ewing an official of westland oil inc regarding the fractions on cane creek shafer and lockhart structures which are claimed by the company on the ground of an alleged error in the original location surveys the westland oil people have applied for prospecting permits on the fractions and it is reported they have sold drilling contracts on the area to the associated oil company of california following is mr ewings letter received by the times independent yesterday salt lake city utah annl 24 1926 times independent moab utah Gentl emten for fear there may be some misunderstanding in your community regarding the fractions on cane creek shafer and lockhart domes which this company recently turned to the associated oil company we are taking this occasion to explain the matter to you arora our point of view when the shafer permits were located on the cane creek dome but on land in approximately T 27 S R 21 E they were tied to the NE corner of sec 34 T 25 S R 21 E an amended location of these claims on october 21 1925 reads something as follows beginning at a point seven and a half miles south and three miles west of the NE corner of section 34 T 25 S R 21 E and running thence etc it was apparently patently ly the intention of the locators of the shafer land to run their boundary so that when the land became surveyed they would be on section lines however townships 26 S R 21 and 22 E are elongated north and south being six males and 1095 chains long therefore the chafers lacked the 1095 chains of going south far enough to get on section lines or what would be section lines when the survey is made when mr prommel located the lands on the shafer permit he assumed that chafers Sha fers sooth line was on what would be section lines when surveyed therefore he must have assumed that T 26 S was six miles long north and south for he tied his claim adjoining chafers Sha fers on the south to the NW corner of T 27 S R 22 E and his location reada beginning at a point four baies west from the NW corner of T 27 S R 22 E etc and thence running in such a manner as to be on section lines or what will be section lines when the land is surveyed consequently you will readily see that shafer and prommel left a strip of land between their two permits 10 95 chains wide this strip two and one half miles long was open land claimed by nobody and the claimants of the other permits should blame only themselves for their oversight shafer got what he asked for prommel got what he asked for and will get what we ask for these locators committed the same mistake on the other domes some people to thing that monuments may have something to do with the matter in question but the leasing law is entirely different from the old mining code and monuments will cut no figure if the monuments set are not m accordance with the tie to fixed known corner atones rt ones then the monuments and the survey by which they are set are simply erroneous on a theory that monuments control in such a case it must be patent to any right thinking man that there would be a continual continuous in these matters because all the first locator need do to change his lines would be to change his monuments but let us anve home the final conclusive evi dence as to our ight to the fractions shafer said beginning at a point seven and one half miles south and three miles west from the northeast corner of section 34 that point ia still there and all the engineers in the employ of all the other companies cant quite move that point unless they the northeast comer of section 34 likewise prommel said beginning at a point four miles west of the northeast corner of 27 south R 22 east that point is still there like the old fable thes two posits are still there and all the kings horses and all the icings men cant change them around again i tan this modern day of bureaucrats and autocrats some people con eider it a came for an american citizen to assert his rights without asking the powers that be in that particular industry unfortunately or fortunately the writer hereof was bom down m the good old south where individual and state rights are considered birthrights and we dont propose to be denied such rights or be bluffed or beaten by regardless gard less of their standing or wealth you have aly authority to pant this statement if you wish yours truly ORMAN W EWING |
