Bagby, eity editor of the Herald-Republican, to appear ap-pear in court to show cause why tht-y should not be punished for contempt. This order was argue I this morning As a result of the hearing taday, Judge Marshall ordered the ctfee of the United States district attorney for Utah to institute proceedings against the three men named, ordering them to appear to show cause1 why they should not be punished for criminal contempt. Whenvthe order was mad District Attorney H. K. Booth said that he was an 'officer of the Herald-Republican company and Judge Marshall responded that he anticipated that one of his assistants as-sistants could draw the information and prosecute 'the case. Judge Marshall also told the attorneys attor-neys for the complainant that they would have the right to appear in the hearing and present any evidence that they desired. |
