Show GETS WRIT AGAINST JUSTICE OF PEACE On the ground that a 'Judgment was entered against him illegally, W. J. Moore has filed a bill in the District court asking that he be granted a writ of prohibition pro-hibition to restrain Justice of the Peace C. F. Durand of Murray from taking further fur-ther action in the case and attempting to enforce the Judgment. According to the complaint suit was filed In the Justice court by HemBley & Emsley. May 21, 1906. Moore declares that after receiving the summons he proceeded in the regular way, . filed an appearance and an affidavit objecting to the Jurisdiction of the court on the ground that he was not a resident of Murray precinct. Despite this fact It is declared that Durand arbitrarily entered en-tered Judgment and is attempting to force Its collection. Judge Morse Issued the writ. ' |
