Show MUST SEE ALL THE WITNESSES County Attorney Will Not Act In Smith Case Until He TalKs With Persons Named in Complaint. County Attorney Christensen will not have a warrant issued for tho arrest ar-rest of President Joseph F. Smith on the statutory complaint sworn out by Charles Mostyn Owen until he has personally per-sonally talked with the witnesses named in the complaint. This is the statement given out by the County Attorney after an extended conference with Mr. Owen on the subject. sub-ject. Mr. Christensen said: "So far Mr. Owen hss not presented a case which will justify me in causing a warrant to issue for President Smith's arrest. I intend, however, to interview or cause to be interviewed every person he names as a witness, and if their statements justify it, I will undoubtedly undoubted-ly cause President Smith's arrest. I want it distinctly understood that 1 am not afraid to arrest Joseph F. Smith or anvbody olsewho violates the law. But' T am not going to institute, a prosecution until I know that it can be maintained with some prospect of success." The fact that a certificate of th birth of. a child to President Smith's plural wife had been filed by Dr. (!. F. Wilcox was not mentioned in the complaint. com-plaint. Wilcox declined to make a statement state-ment regarding the birth of a child to Joseph F. Smith and M. Taylor Smith, which he certified was legitimate, merely stating that the certificate of birth was in regular form. |
