Salt Lake for many a day was the plan resorted to yesterday by Detectives Burnhardt and Rhodock of Cleveland,- O., to secure possession of the person of Dr. David P. Maxwell, who Is wanted In the Ohio city to answer to the charge of having performed a criminal operation on a young woman as a result of which she died. . - Dr. Maxwell was arrested In this city over three weeks ago under an assumed name. , The Clereland officers arrived In, this city a few days later with requisition requisi-tion papers which were promptly signed, bs Gov.. Cutler. : A ; writ of habeas corpus waa at once applied for and granted In behalf of Maxwell upon which he was discharged by Judge Armstrong. ' Maxwell waa immediately Vearrested. Another v writ was applied for and granted and Maxwell was turned loose for the second time only to be rearrested. rear-rested. Last Monday the second set of requisition papers arrived from Ohio and were presented to the Governor. The attorneys for Maxwell made a hard fight before the Governor to prevent pre-vent bird from honoring the papers. The Governor, however, honored them and the third writ of habeas corpus was secured. se-cured. This writ was argued before Judge Ritchie at noon yesterday and denied, the Judgment of the court being given wt 1:05 p. m. ; Attorney Brlgham Clegg at once gave notice of an appeal , to the 8uprem court and was Informed that the notice would not act as a stay of proceedings. Court was then adjourned until 1p.m. A few minutes later. Attorney Clegg went to Judge Ritchie and asked permission per-mission to file a request for, a stay of proceedings. Judge Ritchie Informed the attorney to present. his papers as soon as they were ready. In the meantime the prisoner had left the courtroom In company of Deputy Sheriff Andy Smith, Jr.,. and the two Ohio officers. V Under the ruling of the court the local officer had nothing to do but turn the man over to the officers from the East, which was done. Messrs. Burnhardt and Rhodock were prepared for Just such an order as the court made In the case. " ,v A closed carriage was In waiting at the east door of the Joint building; into in-to this Maxwell was hurried. The driver had been given his Instructions and lost no time in following them.' Besides the two officers and their prisoner the carriage car-riage contained the baggage of all three. - When the 1130 p. m. "Overland Limited" Lim-ited" pulled out of the Oregon Short Line depot It. carried among its passengers passen-gers the two Cleveland officers and Dr. MaxwelL Attorney Clegg stated this morning- that he did not expect to take any further action in the matter.
