Show AFTER THE BEEF TRUST Attorney-General Galen of Montana Flics Appellants' Appel-lants' Brief. HELENA, Mont, Aug. i-In the beef trust cases, now on appeal before the Supreme court Attorney-General Albert Galen hasfiled the appellants' brief with the clerk of the Supreme court. These cases were brought, by former Attorney-General Attorney-General James Donovan . against the Cudahy Packing company, the Hammond Packing company. Armour & Co., Swift & Co.. charging them with having formed a combination for the purpose of controlling con-trolling prices on, packing-house commodities. commodi-ties. . ' The State lost the case in 'the lower court of Lewis and Clark county, when Judge Henry C. Smith sustained the demurrer de-murrer of the defendant companies on the ground that the law is unconstitutional. The brief of Attorney-General Galen refers re-fers to the decision of the Supreme court ofllllnols, in which the anti-trust law in that State was held unconstitutional and upon which the defendants base their case. - He claims, bn behalf of the State, that this decision will not apply to the Montana Mon-tana law, because of the differences in the Constitution, that of Montana containing con-taining a clause which makes it mandatory manda-tory on the State Legislature to pass a law forbidding all corporations to enter into a combination or trust |
