Show NEW TESTIMONY IS TO BE IN fRODUCED BY DEEENSE The first' sign that the defense intends in-tends to Introduce new testimony In favor fa-vor of James M. Shockley was shown this morning in Judge Armstrong's court, where Shockley is being tried for the murder of Amasa I Gleason, a street car motorman, on the night of January 6, 1904. . . When the case was called this morning morn-ing Attorney H. A. Smith, counsel for Shockley, asked permission to file an affidavit for his client and also to be allowed to conduct experiments with the bullets that were used as exhibits. The requests were granted by the court J and the affidavit was placed In the court records to be used as some future time. Contents Are Secret What It contains will not be made public until after the defense is called. This move is thought to be a foreshadowing foreshad-owing of a new stand to be taken by the defense. j . . - . The first witness to be called this morning was . Beckstead. to whose place Brighton was taken after he waa shot He told of going to the car after the men were shot. He said that Glea-' Glea-' son lay face down on the floor with his arms circled above his head. A few inches from his right' hand was laying a revolver. This waa brought out In the cross-examination conducted by Attorney Smith. Finding of the Chin. . ? .. The finding of the gun used by Shockley was told of by City Detective George Chase.- He said the weapon was found in a place described by Shockley in his confession. Three chambers of the gun had - been discharged dis-charged and the remaining two were loaded. Sergt. Eddlngton told of carrying Brighton to the Hqly Cross hospital and witneising the dressing of the wounds. Dr. J. S. Richards and Dr. Beer gave expert testimony on the wounds found on Brighton's body. He said .the bullet had entered the lower left chest. Another witness was Dorr Marsh, who was a car cleaner at the time of the tragedy. On cleaning the car he said two bullets were found In the car. Dr. C. P. Wilcox was called as a witness wit-ness at the afternoon session. |
