Show JOE BUSH'S THICK. YThat lio CbioKnio OHlrlaU Hid VVhen They Learned or it. Yesterday Uie JCews published an account of the arrest, by Deputy Bush, at Trinidad, Colorado, of 5Ir. John Hopkins, on a charge of unlawful un-lawful cohabitation. The Denver -Vetr also has an account of the transaction, which it placts under the following headings: "Bush's Bold Bluff. A Mormon Marshal tries to take a Prisoner Out of Colorado Colo-rado Against the Law. He Fails in the Attempt and Goes Home to Salt Lake City Kmpty-handed." There is one striking inaccuracy in this heading, and that is, that Joe Bush isa "Mormon marshal." He Is a deputy United States marshal, and much of his time lor several years has been spent in hunting for "5lormons" accused of violating the Kdmunds law. and he Is one of the class that has heretofore been petted aud encouraged by the Denver Den-ver paper. Now that Uiey have had an exjierlence with him in Uoloiado, here is what is said of it: "Deputy 1'nite-t States Marshal Bush of Utah has been guilty of great discourtesy to his brother officials in Colorado. He made an effort to violate a well known law, but was called down by Uncle Sam's servants here. Ill the Territory ol Utah, as is well known, to disre-ganl disre-ganl customs established in other States is not considered a misdemeanor. misde-meanor. Theileiiuty marshals set Uie example. Whenever they want a man, it matters not where he is, Uiey go for him. It has been customary cus-tomary for them to go up into Idaho aud arrest men there and take Uien to Utah. They wcreable to do this with imtiuuity in a Territory and thought they could do Uie same in an organized State. 5tr. Bush learned that he could wot. The law and the rule Is that when Individuals Individ-uals are wauted in a United Slates court in another Statu or Territory, the warrant is delivered to the marshal mar-shal of the State In which Uie person per-son lives. This official makes the arrest and it Is usually customary lor the prisoner to be brought liefore the nearest United States commissioner commis-sioner and give bonds for his appearance ap-pearance at the place he Is wanted at the appointed time. No requisition requi-sition papers are nenssary, but the arrest is not legal if made by the marshal of a different district than that for which he is apj-oiuted. "Deputy Marshal Bush went down to Trinidad a few days ago and there arrested a man by the name of John Hopkin. Having done this, he was proceeding to take him to Utah. Hojikin was wanted for an alleged violaUon of the Edmunds Mormon law and the warrant for his arrest had been made out in I'tah. It looked as if he was going to reach the line all right, when he was Intercepted In telegrams from Uie offices of th United States marshal and Ununited Un-united States district attorney. These commanded him to take the prisoner luck to Trinidad or Iutblo, as he might choose, aud instructed him to take him m fore a United States Commis-ioner. Bush did so and landed in Putblo with his man Sloiiday. Hopkin was arraigned and lound over in the sum of 51..VH) lo the United States eouit. lit gave this amount ot loll for hi :i pearanc" at the pmncrtimc in Utah. Bush then returned to Utah empty handed, having all his trouble for nothlug.'' |
