Show RECEIVERSHIP SOUGHT IN COURT ACTION A judgment of S104. 521.76 against G. S. Wood of G. S. Wood Mercantile Company, Reinc, Springville, is sought in an amended amend-ed complaint now on file with the clerk of the district court in Provo. The judgment is asked in favor of the corporation. A second judgment is sought against his wife, Catherine M. Wood, in favor of the corporation for $2,153.10. The plaintiffs also contend that "pretended" claims of the Woods against the corporation corpora-tion "are' without consideration and void as against the corporation." corpora-tion." A full accounting of the firm from the date of its incorporation until the present time, ordered from R. E., G. S., and Catherine Wood, is also sought. Plaintiffs contend that during its years of existence the company com-pany has done in excess of $1,-200,000 $1,-200,000 but has never paid out any dividends to stockholders. They also maintain that Mr. and Mrs. G. S. 'Wood 'have also "converted" "con-verted" to their "use and benefit" assets of the company. No accounting ac-counting has ever been made they declare. The sums asked are believed to have been assertedly taken by Mr. and Mrs. Wood during the firm's years from 1904, and converted to their own use, it is alleged. A restraining order to prevent depletion of firm assets, and a receiver re-ceiver to conduct its affairs are also sought of the court. Plaintiffs in the action are stockholders of the corporation and Rhoda R. Dougall, administratrix adminis-tratrix of the estate of Hugh M. Dougall. They are represented by A. V. Watkina and William H. Streeper. - The preliminary hearing on the complaint was heard yesterday in the district court before Judge Abe Turner, who promised a ruling rul-ing by Saturday- Sept. 17th. |
