BE IT ORDAINED BY THE CITY COUNCIL COUN-CIL OF SPRINGVILLE, UTAH: SECTION 1. Finding of Jurisdiction to Create Special Improvement District. The City Council of Springville finds and declares that, pursuant to the order of the Council duly made at a special meeting meet-ing of said Council held August 13, 1962, and in pursuance of the provisions of Section 10-7-41, Utah Code Annotated, 1953, there wasduly published in four consecutive issues of the Springville Herald, a weekly newspaper published in Springville, Utah, on the following dates, to-wit: August 16, 23, 30 and September 6, 1962, a "Notice of Intention" of said Council to create a special improvement district dis-trict in said City to be known as Improvement District Number 10, and to make the improvements hereinafter specified within said . special improvement improve-ment district, and of the further intention of the Council to levy special taxes as provided in Article 7, Chapter 7, Title 10, Utah Code Annotated, 1953, on the real property lying within said district for the benefit of which such special taxes are to be ex- SECTION 3. Approval of Plans and Specifications. Specifi-cations. The Council finds- and declares that the City Engineer, pursuant to the direction of the Council, has caused detailed plans and specifications specifica-tions and construction contract forms for the improvements im-provements specified in said Notice of Intention to be prepared, which detailed plans and specifications and contract forms were submitted to and inspected by the Council. The said plans, specifications and contract forms are hereby adopted and approved. SECTION 4. Declaration of Publication of Notice to Contractors. The Council finds and declares de-clares that notice to contractors with invitations to submit proposals to the City of Springville for the construction of the improvements aforesaid has been duly published in the Springville Herald pursuant to the direction of the Council and in the time and manner required by law. A copy of the notice as published, together with proof by affidavit of the publication thereof has been filed with the City Recorder of the City of Springville and is hereby referred to and made a part hereof. "-SECTION 5. Mayor Authorized to Contract for Improvements. The Council further finds and pended in making said improvements. A copy of said Notice of Intention as published, together .with the publisher's affidavit proving said publication, have been filed with the City Recorder of the City of Springville and are hereby referred to and made a part hereof. The said notice duly stated the purpose pur-pose for which said taxes are . to be levied, the ; boundaries of said Improvement District Number 10, and in a general way described the improvements improve-ments proposed to be made with the estimated cost as determined by the City Engineer. Such notice specified that protests or objections to such im-: im-: provements must be filed with, the Springville City Recorder on or before the 7th day of September, 1962, and at a meeting of the Council, duly held on September 10, 1962, the Council considered each and every written protest filed within the time so limited and heard every person appearing to protest against the creation of said district and the construction con-struction of the improvements therein and the levy of the special taxes to defray the cost thereof, and . upon such consideration duly determined, and does hereby determine, that the written objections to the making of such improvements and levy of such tax i I filed with the City Recorder within the time limited, j: I amounted to less than two-thirds of the frontaee of declares that pursuant to the notice and invitation to contractors aforesaid proposals for the construction construc-tion of said improvements have been received by the City Council and tabulated and evaluated by the City Engineer. The said bids and proposals were received by the City Council of Springville City at a meeting on September 10, 1962, and examined by the Council and the Council thereupon determined, deter-mined, and does hereby determine that the bid of Bouchard and Stark for the construction of said improvements for the total contract price of $46,-422.30 $46,-422.30 is the best and lowest bid and that said Bouchard and Stark is the lowest responsible bidder for the construction of the improvements aforesaid. The Mayor and City Recorder of the City of Springville Spring-ville are hereby authorized and directed to let to said Bouchard and Stark the contract for such improvements im-provements and in behalf of and in the name of the City of Springville to execute a contract with said company for- the construction of said improvements in accordance with the plans and specifications, which contract shall be substantially in the form hereinbefore approved. SECTION 6. Special tax levy to be made. When said improvements have been completed there shall be levied and assessed as provided by Article 7, Chapter 7 Title 10, Utah Code annotated, 1953, special improvement district taxes upon the blocks, lots or parts thereof and pieces of ground fronting I ; J tne property abutting on or adjacent to the streets r j to be improved and that the frontage represented j by such protests was and is insufficient to deprive . the Council of jurisdiction to make said improve-: improve-: ments and levy said tax. The Council now finds, H!; determines and declares that it has jurisdiction to proceed and to order the making of such improvements improve-ments as provided by law. I: SECTION 2. District Created Boundaries and Improvements. Pursuant to the jurisdiction ac quired, as hereinbefore set out, there is hereby created within the corporate limits of the City of Springville, Utah, for the purpose of constructing curb and gutter and sidewalk as described in the said Notice of Intention, to which reference is hereby, made, a special improvement district to be known as Improvement District Number 10. The property affected and which is to be assessed in said district consists of all those lots and parcels of land abutting on the sides to be improved of those certain streets hereinafter designated for the distances and between be-tween the points indicated and running back from the street line the entire depth of each such lot and parcel of land or 165 feet, whichever distance is the lesser. Sidewalk improvements are to be constructed along the following named streets for the distances and between the points indicated, to-wit: or abutting upon or adjacent to the streets improved, affected by or specially benefited by such improvements improve-ments to the entire depth back from said streets, not exceeding, however, 165 feet, with comer lot exemptions for curb and gutter of one-half the distance dis-tance of the shortest side, and such special improvement improve-ment district taxes so assessed shall be used to defray the cost of such improvements. SECTION 7. Emergency Clause. In the opinion opin-ion of the City Council of Springville City a public emergency exists in connection with the matters herein contained and the Council hereby finds that it is necessary for the immediate preservation of the peace, health and safety of the inhabitants of the City of Springville that this ordinance become effective ef-fective immediately. SECTION 8. Effective Date. This ordinance shall take effect upon its adoption and first publication. publica-tion.
