| Show TRUSTEES SALE whereas samuel liddiard and sarah liddiard his wife and thomas collins and mary gollins hia wife executed acknowledged and delivered to james H bacon trustee their certain deed bearing date the ast 1st day of january A D 1893 to secure the payment of twenty three hundred dollars and the interest thereon at the rate of nine por cent per annum according to the tenor and effect of a certain first mortgage bond bearing even date with said trust c eed and payable on the first day ot january A D 1898 and tho interest notes to eaid bond attached for each payable on alie first days of january and juh each year during the time said and had to run and which said trust deed was given upon the following described promises to wit beginning at the northwest corner of the southeast quarter of the north embt quarter of section 26 in township 6 south of range 2 east of the salt lake meridian running thence south 5 chaice thence 10 chains thence north 5 chains thence west 10 chains to the place of beginning also the southeast quarter of section 14 in township 6 south of eange 2 east of the salt laface meridian also beginning at a point 40 rods north and 40 rods west of the southeast corner of the northeast quarter ot section 26 in township 6 south of ranga 2 east of the salt lake meridian running thence west 40 roda thence north 20 rods thence east 40 rods thence south 20 rods to he placa ot beginning also thirty two 32 shares of the capital stock of the prevo bench caamal and irrigation company said trust deed was recorded in the recorders office of utah county in book 17 of mortgages etc on pages 5 6 and 7 and whereas it is provided in said trust deed among other things that in case default be made in payment of said bond or notes or any of the indebtedness secured by said deed that then said trustee shall sell and dispose of said premises and all the right title benefit and equity of redemption of the said samuel liddiard and wife and thomaa colling and wife their heirs and assigns therein at public auction at the aront door of the county court house in said county of utah for the highest and best price the same will bring in cash after giving thirty days previous notice of such eale by publication in any newspaper at such time published in said utah county find to make execute and deliver to such purchaser or purchasers at such sale good and sufficient deed or deeds for the premises sold and whereas said liddiard and wife and collins and wife have each and all made default in the payment of said coupon due january 1 A T one due july 1 A D 1896 and one due january and have neglected to pay the same or any part thereof there oi and WHEREAS the holder of said bond and notes has declared said bond and the indebtedness secured by said trust deed to be now immediately due and payable and requested said trustee or the successor in trust to advertise and sell aard premises pursuant to the power aad authority granted by said trust deed and upon the terms and conditions therein expressed and WHEREAS it is also provided in said fiust deed that in cape of the absence from said county of utah or inability to act of said james H bazon that then harvey M bacon is made successor in trust in and by said trust ased with like power and authority and WHEREAS said james H bacon is absent from said county of utah and unable to act on the premises now therefore public notice is hereby giyen that I 1 harvey M bacon ae successor in trust will by virtee of the power and authority in me vested in and by said trust deed on the dav of february A D 1897 at 12 noon at the front door which is the north door of the conaty court house in the city of provo in said county in the state of utah sell at public auction to the highest and best bidden for cash eaid premises and said gatei righta together with all the licht LiR ht title aad benefit and equity of redemption of the said samuel dard and thomas colline annmary dMary an collina their heirs and assigns therein and will execute and deliver to the purchaser or purchasers at said ealey good and sufficient deed or deeds of conveyance for and transfer said water rights Bated this day of january A D 1897 BACON successor in fiust |
