Show 'WETS' WIN IN lOJECTl Ratification of U. S. Prohibition Pro-hibition Amendment Overturned Over-turned at Polls. By Universal Service. COLUMBUS, Ohio, Nov. b. The ratification rati-fication of theeoferal prohibition amendment amend-ment by the Ohio state legislature was overturned at the polls last Tuesday on the basis of complete official and unofficial un-official returns at hand today. Complete official and unofficial returns gave a total of 47-1, o22 against and 463,-76S 463,-76S for ratification. The Crabbe prohibition enforcement state 'law on the same figures was defeated de-feated by more than 25,000 votes. If the final figures show the same result, re-sult, tho "wets" claim that the proclamation procla-mation of acting Secretary of State Polk last January declaring the national amendment ratified by thirty-six states was . illegal, because Ohio was Included in the number. It is said that. Mr. Polk acted either on a forged copy of the resolution or in spite cf the governor's letter of warning that Ohio had a referendum refer-endum provision on legislative ratifications. ratifica-tions. Since Mr. Polk chose to ignore the letter, there is a serious question now whether his proclamation' has legal vitality. vi-tality. If his original proclamation is not void, national prohibition will come into effect a year from tho date of Its issuance. Fifteen other states In the union have similar referendum provisions. In the United States supreme court the case is cxpcted to turn on the meaning of the federal constitution when it said that the amendments shall be effective when ' ratified by the "legislatures" of three-fourths of the states. The United States supreme court unanimously upheld up-held the Ohio supreme court when the Ohio court said, in a congressional district dis-trict gerrymander case, that "legislature" "legisla-ture" comprehended the broadest Iaw- (CoHtimied on Page 4, Column 4.) i 'WET' FORCES WIN II OHIO ELECTION .
