Show REFUSED admittance commitment papers to the asylum not legal the salt lake tribune this morning contains the following sheriff hardy has a white elephant on his hands in the person of jacob madsen who was committed to the in sano asylum at provo yesterday but refused admission to that institution for the reason that the papers in the cabe did not bear the seal of the probate court of salt lake county madsen who is a dangerous lunatic was arrested baat saturday and com bitted to the asylum yesterday after a hearing As county attorney whittemore had reported to the court that the law did not require anything whatever to be done by the clerk of the probate court in insane hearings county clerk stanton had not placed his seal upon the papers in the case and when deputy sheriff steele appeared at the threshold of the asylum with madsen yesterday afternoon dr pike refused to admit him dr pike pointed out so mr states that the impress of the county beal did not appear upon the papers BE provided by law and stated most em that no patient would bo ad bitted to the asylum in any auh irregular manner dr piko is reported to have said that the ucb tie sheriff is holding au sen is illegal and that the sheriff should release him unless the seal of the court ia placed upon the same at once the county court will probably take borne action in the matter today as madeen is sadly in need of attention there has been a dispute it should be added between the salt lake county court and clerk stanton as to the fees in these cases the court has held that certifying such papers are among his regular duties and he claims fees tor that service this case will probably settle the question |
