speaker your commilee comm ieee on elections to whom was referred the matter of the contest of hueh M dougall for tha seat in this bouso now held by alexander robertson under and ty of a certificate of election issued by the utah commission beg leare to report as follows under agreement of counsel for the respective carlies par lies a special commis kijner sij ner E A wedgwood esq of provo wae appointed to take testimony at various places within the eleventh and twelfth legislative districts this testimony with other papers was duly presented to the committee and after argument by counsel for the parties the question was considered at leneth by c lamitee lami Uee the parties agree and the committee finds that Spring villa city and spring ville precinct haye bad since 1883 and until the formation of mapleton pre the same boundaries that spanish fork precinct lays adouth aad west and to springville Spring ville precinct up to the time when mapleton precinct was created that in 1891 tb utah in pursuance of law the territory of utah for legislative elections that spanish fork precinct was assigned to the twelfth disi brict abat in tha year 1892 the county court of utah county wherein said precincts are situated created a new precinct and named the bamo mapleton said mapleton precinct was formed from territory lying within the afore aard Sorin iville and fork pra cincis that is to say the territory parti ally within each the eleventh and twelfth legislative districts thus the county court ot utah county the territory ot utah for legislative elections if the results following their acteon be confirmed but thare ia BO power granted county courts for such a purpose the lawa of congress Uon gress laws of 1890 and 1891 provides a method of dis tiBe the territory and expressly ie dares that the districts created there under shall until further provision he made by the congress this is he rule laid down by ane paramount authority the legislature cannot change it much aksa should the power ae conceded tu the county courts if one such court can change the lines of a legislative all can thia would open the way for a constant shifting of legislative district lines to suit the exigencies of elections in those districts many of which we have in this territory we and that twenty five vole counted returned and canvassed as from the eleventh district were cast at the election in question by botera resident in th territory couth of tha line dividing spanish fork and springville Spring ville precincts said territory now beta included with said mapleton precinct That twenty five were baat by voters residing the twelfth legislative district and were warrant of law cast counted and returned aa a part of aard eleventh district that bilty beven were cast within said mapleton precinct at aid election of which tha contestant re fifteen and the conte atee received forty two that contestant received as re tamed by the utah and contested cont estea votes your committee is of the opinion that the twenty five ballots cast by parties residing within the twelfth dia brict should be thrown out and deducted from the total number received by the contestant nud the contested cont estea in said empleton Mp leton precinct in proportion to the number ot votes received bv each in said precinct this would i aduca the contestants total vote in the district to and the contee teea to we therefore recommend that hugh M dougall be declare by the house entitled to sit as th duly elected representative from mhd eleventh district and that his name be placed upon the i roll of the house as such tiye 0 E ALLEN chairman wanted to know if the committee had endeavored to find how the people whose wore thrown out baa voted alien eaid he nut cara to ent r into full district south of a certain line alien then explained how mapleton Ma precinct had been made in 1892 from a part of and a part of spanish fork precincts the boundary between those two precincts mark r ing the boundary line between the eleventh and twelfth dig he said that the botine in this precinct ia all right except in an election fur members of the the committee holds that this division was male in order that the people should vote in the eleventh district the people of the precinct could as well have voted i n the twelfth dietrict in looking into this case the commit tee decided that the twenty five votes should be taken away from the two candidates according to the percentage of votes cast by them in the entire precinct he aard thi is the established rule ebeier asked f the committee had done anything to find out how the twenty five man voted who live south of the line alien cai I 1 the committee did not consider that neca as the rule in those cases is that the votes shall be divided pro rata debaker disputed this argument and s iid that the committee should have endeavored to find how many of the south of the line voted for each of the candidates and if they could not have ascertained this they should then and then only have re sorted to other means of dividing the vote in support of hie arn tinn h read from mccrary on election varian and alien disputed than bid no 3 and over 15 per cent higher aban bid no 6 from the majority report we dissent having bida from the public and parties havins acted in good faith in offering their olds we do not now sea how any discrimination can be mude in favor of anyone because of any condition that may have surrounded aim and further aa no sect parta or organization was barred from bidding we claim it very unfair 10 impose conditions upon them afterwards not con bained in the advertisement we therefore recommend tho award for the public printing be made to bid der no six G for the following follo winz rea bons
