Show PHILBRODK TO FACE CHARGEOF MURDER District Attorney Decides to Make First Degree Accusation. Special to The Tribune. OGDEN, Feb. 16. After careful consideration con-sideration of the evidence as' Introduced at the preliminary trial. District Attorney Attor-ney John C. Davis decided today to file an Information against Frank Phllbrook, held by Judge George S. Barker to the district court for trial on a charge of first-degree murder. Phllbrook Is accused ac-cused of being the ringleader In contributing contrib-uting to the death of Patrick Qulgley, the miner who is alleged lo have died in a rooming house last month from the effects of morphine. As the evidence at the preliminary trial of Phllbrook failed to show that he administered the supposed drug or even that Quigley's death resulted from poisoning, the Information to be tiled bv the district attorney is a broad charge'. It asserts that the crime of which Phllbrook Phll-brook Is accused was committed "In some manner and by some means. Instruments and weapons, drugs and poisons, lo the district attorney unknown, inflicting on and creating in Patrick Qulglev certain mortal injuries and a mortal sickness, a further description whereof is to the district dis-trict attorney unknown, from which said mortal injuries and sickness the said Patrick Quisley then and there died." At the time of the next setting of cases In the districtc ourt the trial of Phllbrook will be placed upon the calendar. |
