Heman and advertise them anew, which would causo considerable additional delay In their completion, or to give Heman another chance was debated de-bated warmly for an hour by the city commissioners' meeting as a committee of the whole yesterday morning. Commissioner George D. Keyser was for taking the contracts away from He-man He-man and giving them to other contractors contrac-tors for immediate fulfillment. The clty a Homes', -however, declared that It would be unlawful to take the contracts away from Heman -wtlhout advertising for new sets of bids. Such procedure would entail hopeless delay so far as concerns the completion of tho improvements tills year. The street commissioner, Richard P. Morris, explained that he believed He-man He-man was now prepared to go ahead with the work and that he probably would complete it in better time than would be gained If tho contracts were canceled and readvertised. Mr. Morris said that the bondsmen for Heman. who had been notified that the city will Insist upon the forfeiture clause of the contracts, were willing and eager to take over tho contracts; and complete them themselves as a matter of self-defense. The attorney, however, declared this could not be permitted under the present form of contracts. The outcome of the meeting was that the city attorney was Instructed to prepare pre-pare a new form of contract for future use so that such, emergencies can bo coped with In the future. Heman Is expected to arrive in the city some time this week. Ho will be called before the commission upon his arrival and made to explain why he has not completed his contracts on time. |
