It was alleged that McFall wns the agent for the" company In Salt Lake and that on May 31. U'll. he drew a sight draft on the company for $S6,fiO. In consideration of certain work lie represented he had done here for the company. The draft was honored. The complainant alleged that after tho draft was honored he learned that McFall Mc-Fall had not performed the work for which he had been paid. The evidence Phowed that McFall had fulfilled, In a measure, his contract with the eastern company. |
