Testimony offered loday at the trial of a suit brought by, Newman Barker against Ilcber C. Parker Par-ker to recover on a promissory note Tor 11000 threw some Interesting light on the alleged frenzied finance dealings of the promoters or the Ogden Resort & Trout company Barker Is suing on a note which was assigned to him by his brother. Joseph Barker, one of tho promoters of the fish hatchery enst. of Ogden. Parker testified today that when the stock was sold for which the notp was given Joaeph Barker represented that Dsivld Eccles and other magnates woro hacking hack-ing the company. This, he said, ho Inter found to he false. Evidence was als0 offered of-fered to show that Joseph Barker had sold about 510,000 worth of stock In tho company among Wcllsvllle citizens upon the same representations. It was shown by the testimony of Joseph Rnrkcr that the note in controvorsy had been assigned with others to the plaintiff for real estate valued sit $4000. although tho consideration considera-tion expressed In the deed was 58000. Tho defense claims that tho salo of stock In the company was made bv the grossest, misrepresentation and fraud and la contesting the payment of tho note upon those grounds.. Several moro days will be taken up with the hearing. |
