Curry, charged with criminal conspiracy in connection with the "Dolly Dimples" circulation contest held In Og-don Og-don for the Evoning Standard, returned a verdict of not guilty at 7 o'clock this evening. The case ngainst Fred Klckersccker, .me of the defendants, was dismissed by Judge Howell yesterday because tho state had failed to corroborate the testimony tes-timony of Fred Van Ness and Miss Beatrix Bea-trix Mtisscr, who were held to be accomplices. accom-plices. In charging the Jury this afternoon, Judge Howell held that Miss Musser also was regarded In law as an accomplice and that unless the jury found some evidence evi-dence to corroborate hor testimony and that of Van Xess a vcrd.ct of not guilty should ho brought in. As Van N'ess and Miss Musser both admitted their part in "the frame-up" they were the most Important Im-portant witnesses called by the state, and. as no other witnesses were present at the time the alleged agreement was made by which Miss Musser was to "capture" "cap-ture" "Dolly Dimples," the state was unable un-able to produce witnesses to corroborate their testimony- |
