Show FIFTEEN yeast ott andy calton FOR MURDERING MIKE CULLEN judge Ander sens lecture in Pt issing judgment andrew calton was called up for sentence friday before andge anderson at beaver and when asked by the judge if he had any legal cause to show why the sentence of the court should not be pronounced upon him mr denny arose and said that although the defendant was convicted of murder in the first degree at his first trial the present verdict showed he was guilty of murder in the second degree only and that be hoped the court would take into consideration the two years imprisonment the defendant bad already suffered judge anderson said the former verdict and judgment were not re geraed because the verdict was unsupported by the evidence but on a legal question solely and that under the evidence in the present trial the jury would have been justified in returning a verdict of murder in the first degree instead of murder in the second degree then addressing calton the judge said mr calton if it were not for the fact that you might properly have been found guilty of murder in the first degree under the evidence and the atrocious manner in which you killed deceased I 1 should have felt disposed to take into consideration the imprisonment you have already suffered but under all the circumstances I 1 think ibe full penalty of the law is none too great a punishment for the offense of which you stand convicted the evidence shows that you said yon procured tho pistol with which you killed cullen for the purpose of killing the first man who in bulted you you and cullen were friends but being under the influence of intoxicating liquor and upon a little trouble arising between you yon killed him that even after you had taken his life and saw he was dead you continued to discharge your revolver into bis body three or four times this with the remarks you made concerning it show this to be a murder of more than ordinary atrocity while the evidence shows that you had both been drinking freely it shows you were not so far under the influence of liquor as to be unable to realize the character of the deed you committed I 1 have no doubt that if you and deceased had not indulged to excess in intoxicating liquor on that fatal day michael cuhen would not now be in his grave and you would not be waiting sentence for murdering him this but adds another to the long list of crimes for which whisky is responsible I 1 trust the circumstances that now surround yon will prove a warning to you as long as you live and not only to you but to all who have witnessed this trial against the use ing liquors I 1 trust that in the imprisonment that now awaits yon you will reflect upon the awful deed that liquor caused you to commit and that you will never use it again and thus be enabled to lead a better life isyou conduct yourself properly while in prison you can very materially shorten boar sentence the judgment of the court is that you be imprisoned at hard labor in the penitentiary tent iary at salt lake city for the period of |
