Show TWO MOTHERS habeas corpus for hie possession of a child on tuesday a peculiar case came up before judge foreman who is assisting judge in disposing of business in the third district court the counsel in the case were zane and zane this being the first case in which judge zane has appeared for the plaintiff and mr deion bof the defense the proceeding was for a writ of habeas for the possession of a child which as in the case king solomon bated has two claimants for the distinction of mother bat the evidence given by the contestants for the possession of the little one their story in brief is that in october 1881 a young girl anna petersen went to the deseret hospital in anticipation of about becoming a mother her child was illegitimate and upon mrs eose kennoy making application for it the mother told her she could have it and that she would never trouble her about it when the kabe was born october 1881 Mrs Kenny took it to her home and has ever since had possession of it giving it all necessary care she has a deep affection for the child looking upon it as her own and is exceedingly averse to parting with it miss petersen recovered from her sickness and went out to work from time to time she visited her offspring at mrs kennels kenneys Ken and when the latter asked her for the adoption papers she would not agree to give them mrs kenny said that if she would give them and it should happen that she should be married and have no children she could have the babe back again in october 1885 miss Peter cen was married to george hansen and went to stockton but she longed for the possession of her child and was not content with the visits she was able to make to see it besides it was growing to regard her as a stranger and was calling some other person mother this state of things led to a demand made last spring by mr and mrs hansen upon mrs kenny for the possession of the child this was refused and suit was instituted at the time the demand was made mrs kenney said you know you cannot love the child as I 1 do and mrs hansen replied 1 I know it and I 1 would not take it from you if you lad not been so mean to me in court the child in dispute a four year old boy was playing about the room all unconscious of the fact that its fate was trembling in the balance it frequently called mrs kenney ma and was evidently entirely estranged from its actual parent who the father of the little one was did not develop almost the only reference made to him being the remark made by tho mother when she looked at the newborn babe it looks just like its father and I 1 hope I 1 will never seo him again |
