Show TUB seekers for salaries ahat tricy did rot earn the old contact between the appointed territorial officers and those who were elected by the people has been renewed in the district court in march last the legislature appropriated 1500 for the territorial rit orial superintendent and commissioner of schools for the years 1886 and 1887 P L viljams Vil hams who was appointed commissioner of schools in 1887 received one half of the amount As ii john nuttall has acted as territorial superintendent of district schools in 1886 having been elected by the people he was paid the other half of the appropriation now mr williams asked the court to issue a peremptory order that tho auditor issue a warrant on tho treasurer for the amount paid to mr and that it be made to mr williams it is claimed that tho latter is entitled to it though he never did the work as ho was appointed by the governor under section 7 of the organic act which says m relation to all except certain officers that the governor shall nominate arid acy and the advice and consent of the legislative council appoint the same the defense claim that mr williams never held the office even in title as while nominated by the governor he was never appointed the advice and consent of the legislative isla tive council never having been obtained the case was argued by van cott and williams for the applicant and judge J G sutherland the auditor the same attorneys also appeared in two other cases those of the auditor and treasurer arthur pratt was nominated for the first named office and bolivar roberta for the other by I 1 the governor but the ad vice and con sent of the legislative council was not obtained that body refusing to accept of the nominations in these cases an effort is made to have the salary of the auditor for 1886 and 1887 paid to mr pratt and that of iho treasurer 1500 given to mr roberts |
