Show BARBER-MOON DEFENSE IS A TECHNICAL ONE Special to The Tribune. BOISE, Idaho, Dec. 15. Pleading the stattio of limitations on thc grounds that titlo to tho land, alleged by the government to have boon fraudulently secured by Sumner G. Moon and James T. Barber, left the government three years prior to tho bringing of tho indictments in-dictments against tho defendants by the federal grand jury. C. T. Jiundy of Eau Claire, Wis., chief counsel fo'r tho Barber Lumber company and the defendants, faced .Tudgo Robert S. Bean of tho Oregon district in tho United States district court, here today in support sup-port of the demurrer submitted by the defense in the case of thc United States vs, James T. Barber and Sumner Sum-ner G. Moon. Iot only did Attorney Bundy "pick over" tho indictment returned re-turned by the grand jury., with a view of demonstrating that it was particular partic-ular in its conspiracy charge, but ho claimed it. was void and worthless. The defense will probably- move tomorrow to-morrow to quash the indictment. Barber Bar-ber and Moon aro to stand trial December De-cember 27. |
