Show FISH AND GAME LAW the following are the amendments to the fish and baine jaw made at the last session of abo legislature to go into effect may sl 1883 SECTION 1 be it enacted by governor and legislative of the territory of utah that adv person who between the day of and the of in each year wilfully takes kills destroy sor fur sale any kind of wild geese or ducks or who shall at any time rob the neata of the abovementioned above mentioned birds or who shall kill any wild geese or ducks hour after sunset and one hour before sunrise shall be guilty of a violation of the provisions of this section csc 2 every person who the day of november of each year and the loth day of august following hakea kills or destroys any dear or who shall at any timo kill any of the above animal for skins is guilty of a misdemeanor SEC 3 any person who puts into the waters of this territory any poisonous li abstance giant powder or other explosives plo upon conviction thereof shall be fined in any sum not less alian or imprisonment not less than one hundred days or may be by both fine and imprisonment SEC 4 it shall be a misdemeanor to taku out of this territory any game taken or killed within its SEC 5 the county court of pach county shall appoint a fish and game commissioner whose tarm of office shall be two years and until ins successor is appointed and qualified said commissioner shall before entering on alm duties of his office take and subscribe to an oath of office and give a bond in the penal sum of 1000 performance of his duties said K jd to be filed with the probate judae the commissioner shall such compensation as shall he determined by the county court to 10 paid out of alie county treasury and shall perform his ducios direction of the county court it shall be the duty of the commissioner to sec that all laws of aliis territory for the protection of fish and bame are enforced and shall report his doings to the county court quarterly all fines and forfeitures for violation of the provisions of this act shall be paid into the county treasury of the county wherein the offense shall have been committed SEC 6 that 1 and 2 of chapter 6 la rs of 1886 be and are hereby repealed the eais considers this lw exceedingly opaque and criticizes it as follows the first lection is a poser it states that those who commit certain acts between specified dates shall le guilty of a violation oi the provisions of this section unfortunately for the cense and efficacy of this section it contains no provisions and does not even assert that the alleged acts misdemeanors it happens also that this samo section one takes the place of the section of tho same number ol 01 the old statute alic latter being repeated As it is a ous concatenation of extraneous pharabe signifying nothing a meaningless legislative void |
