Show acquitted for want of another witness on thurmay afternoon the case of frederick L sheets charged with fornication ni was taken up jis the first district court and a jury called and sworn ogden hiles prosecuted and sheeks defended the evidence was the same as that elicit ed at the preliminary examination held before commissioner norrel a short time aeo miss lulu rich testified that sho had been keeping company with the defendant for over three years and expected him to marry her and that on february ast 1st 1888 he committed the offense with which he was charged with her and that she had since given birth to a child the girls mother and grandmother corroborated her testimony in regard to the defendants keeping company with her although it was shown that she had occasionally gone out with other young men the defense offered no testimony and mr kawlins asked the court to instruct the jury to find a verdict of not guilty on tho grounds that the exclusive association of the defendant and miss kich had not been established and that a conviction could not bo had upon the uncorroborated evidence of the accomplice as to tho offense charged mr hiles thought that the baby was corroborative evidence of the commission of the offense and opposed the motion the court said that the baby was evidence of the guilt or some one but as the evidence of tho accomplice was not corroborated ho would have to instruct the jury to return a verdict of not guilty the verdict was made out and signed by the foreman and when the clerk asked if that was their verdict of jurors mr daniels said it was not his the court remarked that it would have to be the verdict and tho defendant was discharged |
