Show INTERESTING LEGAL POINT IN CASE OE GRANETI An Interesting legal point was raised in .Ijidge l-Hebl's court Wednesday afternoon after-noon in the case of Frank Granell,j a saloonkeeper, charged with resisting and interfering with an officer. Granetl, according to the testimony, ejected W. H Dye, a poll lax collector, who called upon him In the performanco of his official duties, from his houso. The case was set for hearing Wednesday Wednes-day afternoon, but Gruneti, through his counsel, filed a demurrer to tho complaint, com-plaint, contending that the acts charged against him do not constitute the offense of resisting an officer as; contemplated by the statutes. A poll tnx collector Is not a peace officer, it Is contended, and. therefore, a resistance of such an official offi-cial does not como within tho scope of the statute making the resistance of an ofllcer an otTonso. Judge Ulehl will render a decision on the demurrer at 10 o'clock Saturday morning. |
