Works to recognize him as the clerk still, reached another stage Tuesday when Judge Morae denied the demurrer of the defendants to tho affidavit for writ of mandate The matter has dragged for a long time. Wilkitis was clerk under Colonel B. A Wall, wh"n the latter wa chairman of the board. The new board under R. L. Leonard, appointed Frank R. Christensen to the position and the council sustained the appointment Wilkins entered a suit, and asked for a writ of mandate to compel Leonard and the Board of Public. Works to recognize rec-ognize him as the clerk and claiming tne emoluments of the position until November 1906. The city's defense was that Wilkins had formally resigned before the appointment of Christeusen was made, and that he had never been legally appointed in the first, place, had never taken oath of office, and had neer filed a bond a6 required bv law. |
