Stuart, an attorney, today filed application before Judge Barham of the Corporation court for tho appointment appoint-ment of a committee on a convict s estate to collect the life insurance on tho life of Julia Pavlinic, who, being insane, was killed by hor husband at her own request. t . Tho policy is in favor of Pavlinic himself, and ho desires tho monoy to take his case to the Court of Appeals, he having been sentenced to eightoon voars in Uio penitentiary for the crime. The policy is in the Metropolitan Lifo Insurance company of New York and tho company will probably contest the appointment of tho conimittcc. Judge Barham will hear tho motion early in the week. Pavlinic is nn Austrian by birth and, according to all evidence in the case and his own protestation, loved His wife devotedly. Tlie woman became insane and was confined in the asylum at Williamsburg. After repeated efforts sho was released in tho care of her husband hus-band and taken to Camden, N. J. She mado hor escape from him there, and aftor wandering about the country for a wcok was captured in Central Park, New York, and taken to Bellevue, where her history was ascertained. Sho was returned to Willinmsburg. Pavlinic again obtained her release, she having partly recovered, and at hor request ho promised that he would kill her rather than allow hor to be returned re-turned to the asylum again. The woman was all right for sovoral months, and then tho signs of insanity returned. Pavlinic shot his wife whilo sho was sleeping, true to his promise, firing nino bullets into her bod', lie then carefully covered tho body with a cloth and camo to the police station in this city and announced what ho had dono. At. his trial ho denied being insane, in-sane, although three insanity experts testified that he was. 11 o asked that he bo executed rather than conlinod in tho penitentiary, but tho .jury gave him eighteen years. Tuerc is nothing in the policy to prevent pre-vent Pavlinic from recovering, but it will be argjied ts against public policy to allow htm to do so. Tlio fight will be made on these grounds. |
