Show ARIZONA LAND DECISION Involves Point of Acquiring Irrigation Irriga-tion Water by Seepage WASHINGTON, Jan 2 in an opinion opin-ion by Justice Brewer, the Supreme court of the 1'ntted States today affirmed af-firmed the decision of the Supremo court of Arizona In the case of Howard How-ard vs. Perrln, Involving the title to certain lands within the Atlantic & Pacific railroad grant in Coconino county, Ariz. The case Involved the Arizona statute of limitations and the right to use seepage water for Irrigation. Irriga-tion. The decision on those points was as follows. "A statute prescribing a period of limitation In actions between parties claiming only possessory rights cannot he Invoked by one having only a possessory pos-sessory right as against one having a legal title by patent or grant from the ( lovernment. No Right to Sink Well. "A statute giving the right to appropriate appro-priate for purposes of Irrigation water "from any convenient river, creek or stream of running water," gives no right to sink a well, collect In it the water percolating through the soil and ' draw It off in pipes or aqulas for irrigation ir-rigation purposes.
