TAKES LEGAL MIXUP UNDER ADVISEMENT The caso of the State ox rel P. W. and. W. li. Gallagher against .Tndgo M. li. Ritchio and John "Wood, respouu-uuts. respouu-uuts. was taken up in the supremo court on Monday, the matter being an application appli-cation for a writ of mandamus to compel com-pel Judge Kilchio to reinstate and hoar tho case of tho Gallaghers against Wood. Tho matter eamo before Judge lvitchio upon an appeal, and ho dismissed dis-missed both tho appeal and tho case. It appeared that Wood was sorved with a summons three yenrs after the. suit had been filed against him at Murray; also that aftor ho was served the justice at Murray granted him a chango of venue, upon tho condition that the costs be paid. Tho costs wore not paid, and judgment was entered against Wood. ITo then appealed, and .hid go Ritchie held that tho Murray justice did not have jurisdiction of the case, in tho first place, and that he had no right to enter .-judgment in any event aftor tho granting the chango of venue. It was to forco Judgo Ritchie to tc-vcrso tc-vcrso himself that tho application for tho writ of mandamus wns made. At tho conclusion of the hearing tho supremo su-premo court took tho .matter under advisement.
