Musser as Co-Plaintiff. Don Carlos W. Musser, who appears as a co-plaintiff with Mr. Smurthwaite Smurth-waite in the above action, is a son of Hon. A. Milton Musser, of this city, quite prominently connected with the Mormon church. Don Carlos Musser filled a ml.sslon for the church In Germany Ger-many and In Turkey. After his return from the Orient he spent some time as a writer In Salt Lake City. He cn-Ustediind.wjmt cn-Ustediind.wjmt to-.Manlhv.anl-htei special talent being there appreciated he was released from actual work, as a soldier and In tho city of Manila he established the first English newspaper, under the title of "Freedom," which has a world-wide circulation and fame. Most of the homes of America today cherish a copy of Musser's "Fracdc-Dt" as ono of their most sacred possessions. Later he produced a book of sketches and descriptive writing of Manila, which perhaps Is unequaled In the world for exquisite tone of language and selection of scenic views. Dissatisfied With Hierarchy. Both the gentlemen, Mr. Smurthwaite Smurth-waite and Mr. Musser, have been dissatisfied dis-satisfied with the present method of government of the Mormon church the gradual tendency to a class distinction, dis-tinction, the almost royal prerogative set up by the ruling body, which calls Itself the church, and the practical elimination of the muss of the people. In this they are supported by many sympathizers, who will appear aB time shall pass and events shall require. Two Dissenting Votes. Mr. Musser, for Instance, attended the services on Thursday, prepared to make a proper protest to the selection of the officers who were proposed. When President Smith announced that there were two dissenting votes and that they would be heard, Mr. Musser arose to his fool, supposing that the time for hearing had arrived; but the Immediate call for singing by the choir cut off any opportunity. No Antagonism Toward People. Neither one of these men has any antagonism an-tagonism toward the people of the church or the faith. They simply propose pro-pose to make their humble endeavor to stop commercialism and the misuse of tithes, which by their devotion to the misuse of tithes, leaves the poor still In want sometimes in poorhouses. and leaves tho vast financial enterprises, profit making, etc., to deal with the revenues of tho church. Mr. Smurlhwaltc has filed the follow- , I lng copy of appeal from the decision la his case: ' Smurthwalte's Appeal. "Ogden, Utah, April 7, 1905. This Is his answer to the very absurd document which was filed upon him as j the conclusion of the High Council of I ( the Weber Stake of Zlon, at, which I appears as rollows: I The Absurd Document. j "Ogden, Utah, April -1, 1905. An Important Point. It will be observed that the Presidency Presi-dency of the Stake, who, according to 1 the Doctrines and the Covenants of the j Mormon church, hove no voice In the j matter, cut Mr..
