informing him that tho Supreme court of Wyoming has denied the writ of mandamus asked by Sam mon Independent candidate for District Judge of the Third district to compel the Secretary of State to put his name on the official ballot The Judicial situation in the Third and Fourth districts In Wyoming are most peculiar Although elected to nil uncxplrcd terms Judges Craig and Slotts are likely to remain In office eight years Instead of the regular constitutional con-stitutional 1 term of six They were elected about four years ago The terms for which their predecessors were chosen expired this year The Judges claim that they Were elected for six years which gives them two more years to servo Nou I the State constitution consti-tution provides that the Judges shall be elected on the adoption of the Instrument In-strument and cverysix years thereafter thereaf-ter eo It Is doubtfuj If an election two years hence will tl legal as It will not be a multiple of alx from the adoption of the constitution If this view of the law Is upheld the two Judges elected supposedly for four years will remain In office for eight years or until tho election of 1903 The court did not pretend to decide the case on its merits but held that the = Utloner had delayed too long and that It would be Impossible nt this lu dale to hold a fair and legal election for District Judge of the Third district It did not consider the question as to the expiration of Judge CralgH term of office and holds that It cannot possibly be considered In this proceeding In view of existing conditions |
