| Show TOOK MOTHERS HOME Then Refused to Support Her or Give Her Burial SERIOUS CHARGE IN COURT i I Mrs Ellen Walsh Brings Suit x Against HOP Son Says Ho Secured a Deed to Her Home by Fraud and Then Threw Her Upon the World I In a complaint mea by Mrs Ellen Walsh in the District court yesterday i she alleges that her son Henry Walsh I Induced her to give him her property on the condition that he should support sup-port her during her life and give herr her-r burial after her death and that Henry after gaining possession of the property not only refused to piovide for her wants but calmly informed in-formed her tlml he would not give her a good funeral The complaint sets forth that on July 3 1SSO the plaintiff who was 61 years old Iud could not read was induced to set her mark to a deed for certain real estate The defendant represented to her that tho actual condition expressed in the deed was that he should support and maintain her during her life and I give her a respectable burial at her death He further represented that the deed was not to be recorded and that Ills mother wns to remain in undisputed possession of the estate during her lifetime The deed was placed In the Dosefislon of a neighbor aMIs Wolstenholm to hold for Mrs Walsh Several years later according to the complaint when the plaintiff became sick and her mind so Impaired as to render her incapable of attending to her business her son by flattery and constant Importunities Induced her togo to-go to Mrs Wolstcnholm and get the deed lie then represented that her other children were conspiring to defraud de-fraud Mrs Walsh of her property and that It was necessary for her to turn her property over to him On April 20 1806 it is alleged by undue Influence and fraudulent representations repre-sentations the defendant Induced his mother to execute a second deed promising that the first should be destroyed de-stroyed The defendant then recorded both deeds Since the making of the first deed he has failed to support the plaintiff and declares that he will not provide her suitable burial on her death Practically the same charges are made regarding a deed dated April 20 3S96 to the same property The plaln HIT asks that all three conveyances beset be-set aside and Invalidated and the property prop-erty returned to her The land In question is situated on the south aide of First North street a short distance east of Sixth Wrest street and contains 1625 square rods |
