Show MUST fiGHI FOR PAY Suit to Block increase in Judicial Salaries I OFFICIALS MUST ANSWER I Action Begun in Federal Cour Yesterday David Evans and C H Nnnco Hold That the State Constitution Has Been Violated State Auditor Charles S Tlngey and State Treasurer John Do Grey DIxon were made the defendants In a suit lied in the Federal court yesterday testing the constitutionality of the increase In-crease In the salaries oil Supreme Court Judges and Judges of the District courts In Utah Through their attorney attor-ney David Evans the Mine and Smelter Supply company of this city and C IT Nance of Los Angeles are the petitioners petition-ers Both plaintiffs according to the complaInt com-plaInt are taxpayers In the State or Utah in it sum of more than 2000 The utmes nnd dates of olcction of all the Supreme court and District Judges are given together with other data per taming to the petition Tt Is alleged that the compensation or salaries of all the Judges was fixed by the Constitution Constitu-tion and laws of the State of Utah prior to their election and qualification Its It-s set forth that the amount llxed upon as salaries was not to be Increased or diminished during the terms for which the Judges were elected Notwithstnnd Ing that fact the complaint avers C S Tlngey as Stare Auditor during the month of June of this year audited and allowed to the Supreme Couit Judges the sum of 5000 and to the District JUdges 1000 It Is also alleged that John De Grey Dixon as Stale Treasurer Treas-urer honored the warrants It Is declared de-clared that the amount of money that will be taken unlawfully from the State treasury during the unexpired terms of onice of the Judges will be S377C20S unless I un-less such act is forbidden and enjoined In drawing the warrants State Auditor Tlngey pretends to act under II and by virtue of a statute passed by he last Legislature according to the I complaint The act is said to be void as being in conflict with the Constitution Constitu-tion of the State of Utah The petitioners pray that a writ of Injunction pendente lite be directed to the defendants to restrain them from approving or allowing the additional salaries and It Is further asked that such injunction made perpetual |
