S NEW SUIT FILED P A H Franklin Sues Felis Rheinhold ct al Yesterday Judge Dey was up from Salt Lake and filed an action entitled P A H Franklin vs Felix Rhclnbold and James IS Halverson administrator of the estate of Bernard Schwartz deceased The complaint plaint recites that I 1S02 Rhelnbold and Schwartz uocurcd a Judgment of S70250 against Franklin T A Harris It I Armstrong and John B Ellis that subsequent subse-quent to that time Franklin satisfied said Judgment by < convoying to Schwartz certain cer-tain bonds of the New Tlntlc Mining company that tho judgment was never canceled of record und that Schwartz subsequently sub-sequently died that RhomboId now seeks 10 force plaintiff to pay said Judgment again and the court is usked to restrain him from so doing A temporary restraining 1 restrain-ing order was Issued and placed In I the hands of the Sheriff who served It upon both RhomboId and Ilulvcrson They nro directed to appear October than show cause whyit should not be made permanent perma-nent
