Show MOYLES SIDE OF THE FENCE CASE He Gives His Version of the Controversy Contro-versy Over Brighton Road Editor Tribune Several articles have recently appeared in your paper some of which I have not seen stating that I had closed a public road ttt Silver Sil-ver Lake known as Brighton and that I Judge Powers had been victorious in opening It At first I supposed th se articles were Intended as a Joke but I from your statements yesterday and the questions put to me by acquaintances acquaint-ances on my return to the city today deem it but justice to myself and your I paper to state the facts and ask you to publish the truth relative to the matter which Is easily ascertained A year since I became Interested in what Is known as the Brighton hotel properly I found It fenced by Its owners Taylor Romney Armstrong company This fence also Incloses Walker Bros and Dr Andersons land and crosses an old road leading to the I cottages of Walker Bros Dr Ander sons and Judge Powers During the summer of 1000 the fence was occasionally occa-sionally taken down where it crossed the road to permit teams to pass through I erected a new fence in the place of the old one in front of the hotel and extended it to where It connected con-nected with Walker Bros land and I at the request of Walker Bros directed direct-ed the construction of a gate where the log fence had previously crossed the road In question Dr Anderson and I Judge Powers with I a few others asked 1 the County Commissioners a year since I to open this road stating I i had closed it I appeared before the board with the petitioners nearly a year since and then as I have ever since staled that I had no objection to the opening of I this road For I then and now con I I eider It to be to my advantage to have the road kept open that I might as I I have ever since been endeavoring to do sell lots on cither side of it While the road question is undoubtedly undoubt-edly a very old log road Walker Bros I claim that since It was actively used asa as-a wood road they had It fenced for It crosses their land near the point in question Others claimed that It had t been abandoned beyond Dr Ander sons land until Judge Powers com menced to use it And as It I had nevqr been worked or maintained as a county road so far as I can learn I insfsted that so far as I was concerned I would maintain the fence until the Commic cloners would formally locate and ac cept it f as a public road The only re quest thatI have ever made of the Commissioners relative to the matter Is l that the road should be straightened I vheie It passes through the hotel prop crij crijThe The Commissioners promised last year to visit Brighton this year rela tive to this matter and recently the board did so and Isee that they found no dlfllculty In making a satisfactory settlement of the muchtalkedof con troversy and Victory of Judge Pow ers I repeat that I hesitate to fur ther burden your readers with this muchheralded but l bloodless contest Respectfully yours I JAMES II MOYLE |
