Show MAY ATTACK JAIL 1 I FRIENDS OF CONDEMNED HAN WILL RESIST HIS EXECUTION He Was Convicted on Circumstantial Evidence and Is Believed by Majority Ma-jority People to be Innocent I Butte Mont March 2S Reports I from Helena and Glendive indicate there may bo serious trouble Friday I over the execution at Glendlve of Joseph Jo-seph Hurst under sentence of death I for the murder of Dominick Cavanaugh Hurst and Cavanaugh were opposing candidate for Sheriff of Dawson county I coun-ty at the fall election of 189S Cavanaugh Cava-naugh was a Democrat Ilust a Republican Repub-lican Cavanaugh won Some weeks later he was found dead in an alley at Glendlve with his skull crushed In The commissioners of Dawson commissioner appointed ap-pointed Hurst to the vacancy Later he was arrested for the murder and con vlcted The evidence against him vaa altogether circumstantial and based largely on the outcome of the election I On appeal the Supreme court could llnd I no error In the legal proceedings but commented severely on the testimony I though under established rule in such cstablshet cases unable to go into that branch of the subject Friends of Hurst have been working for weeks to secure commutation of sentenco or at tho least sufficient reprieve II re-prieve to allow them to hunt up evidence evi-dence to show that Hurst Is Innocent This morning word came from Helena that the Governor refused to Interfere and Hurst must hang Friday From Glendlve comes word that Hursts friends are determined to prevent what they consider a legal crime and injustice injus-tice even If it becomes necessary to attack the jail and rescue the prisoner Hurst is only 29 years old and well I connected The dead man was Sheriff at the time of his reelection and the murder He was very popular Hursts friends claim there was no testimony teslmony I to warrant conviction beyond that of a man who has disappeared from Glen I dlvo since the present excitement began be-gan Fourfifths of the prominent people I peo-ple of the State petitioned for the clemency 1 clem-ency the Governor refused |
