Show BECKS LIFE INSURANCE Reed Recovers His Commission for Writing the Policy The trial court was affirmed In the case of W J Reed vs the Union Central Cen-tral Life Insurance company of Cincinnati Cin-cinnati appellant Reed the local agent of the defendant court wrote a policy for 100000 on the life of John Beck The first premium amounting to 3702 was paid by Bock giving three promissory notes two for 52000 each and one for 51702 The first note was taken up when the company according to the testimony at the trial through Information received from an insurance agent named Charles St Morris came to the conclusion that Beck was In a poor way financially and also that he was suffering from Brights disease and was not a good risk and the company com-pany became dcslious of canceling the policy Through St Morris and Special Agent Waters of the company this was effected on the payment of 500 to Beck and the surrender of the two notes for the first years premium which remained re-mained unpaid Reed this plaintiff claimed that ho was according to his agreement with the company entitled to receive 50 pet cent of tho first years premium as his commission for effecting the insurance Reed received 1000 half of the first note which was paid and some other small sums and brought suit to reuovir 50 per cent of the two notes surrendered sur-rendered on the policy being canceled The defendant company contended that the plaintiff was entitled to commissions commis-sions on the premiums paid In cash and I no mdreami thatrjf he had any claim for more he waived it by helping to ob tnfn a cancellation of the policy and consenting thereto In the trial court Reed obtained a verdict and Judgment for the amount of his claim 1003 which was now affirmed The opinion was written by Justice Miner Justice Baskin concurring and Chief Justice Barlch dissenting |
