It will be remembered that a short tima ago Mrs. Bella Fitzgerald brought salt for dlTorce against M. Fitzgerald, a welLknown saloonkeeper and sporting man, and in her complaint the plaintiff made serious charges against her husband. Mr. Fitzgerald eon. tented himself with denying that he had ever piren his wife ground for complaint, and claimed to have good defense. Since then Mrs. Fitrgerald hse evidently thought the matter over, and the result is that the case has been dismissed at her Instance. The Rapid Transit Answers. Is the case of the Great Salt Lake & Hot ' Springs railway vs. the liapid Transit, in which the plaintiff seeks to have defendant restrained from erecting a line of poles in close proximity to the plaintiff's road on Third West street, and for $5500 damages, the defendant today filed an answer and cross-complaint denying the alleged trespass tres-pass upon plaintiff's road and setting up the francklse granted in support of this claim. Besides the franchise, the defendant alleges that the line of poles, etc., was set up under agreement with the plaintiff. The Rapid Transit also , alleges that the' plalntifE threatens to construct a double track rail, way in violation of the defendant's rights, and an injunction is asked prohibiting tha construction of such road.
