The council, It will be remembered, was about to remove Kesler, when the latter obtained ob-tained a writ of prohibition, and the motion to make it permanent was submitted on Thursday. Hie honor held that Kealer was not a police Justice at an, but merely a justlee of the peace, designated by the council to have exohisive jurisdiction ! over cases ot violation of the ordinances. That being true, It was not necea&ary for tho council to file- charges against him or go through any form whatever In ; removing him, becauee euch action did not touch the tenure to the office of Justice ot , the peace, to which he was elected.
