Show TRUSTEE S SALE WHEREAS LEONARD S. Osgood and Ruma L. Osgood, his wife, on the rirrt day of December, IBM, made, executed and delivo.-ed" to Emil J. Raddatz their certain promissory note for the principal sum of three 1 thousand three hundred an:! sixteen SO-100 dollars, payable to the order of said Emil J. Raddatz, j ninety .'ays after date thereof, with interest thereon there-on at the rate of one (1) per cent per month until paid, and Whereas, To secure the payment of said note the taui Leonard S. Osgood and Ruma L. Osgood on i-aid day made, executed and delivered to s. McDowall a trustee for the said Emil J. Rad- i datz their certain trust deed in writing of that date, which said trust deed was duly certified, ; acknowledged and re orded in the office of the Coanty Recorder of Tooele County, Utah Terri- , tory, on the third day of December, 1891, and j thereby conveyed to said McDowall the following : mining property, tow.t.: An undivided three- j fourths () interest of, in and to the "No-U- I Don't" Lode, mining claim, situate iu the Rush i j Yalley Mining District in the said County of : ! Tooele, designated as V . S. Survey, lot No. 88, and j j more particularly described in aud by said trust I i deed. Also an undivided three-fonrths (?) inter- j j ect of, in and to the Laura Lode, mining claim, ; j ituate in the said Rush Yalley Mining District, j I County of Tooele, Utah, more particularly de- j I scribed in and by the location certificate thereof I j recorded in Book F, at page 18:2 of the records in ! ! the office of the District Recorder of said Rush ! Yalley Mining District and in and by ald trust I ! deed. Also one (I) upright boiler, engine and blower now upon said "'No-U-Don't" mining claim, and Whereas, it is provided, in said trust deed that in case default be made in the payment of said promissory note, that the said trustee might proceed pro-ceed to sell, and sell on. I dispose of said premises or any part thereof, and all right, title, benefit and equity of redemption of the said Leonard S. Osgood and Ruma L. Osgood, their heirs und assigns therein either in mass, or separate parcels par-cels at public auc:ion on said premises or any part thereof, for the highest and best price the same will bring in ca-h,. twenty days previous notice of such sale having been given by pub-I pub-I lication in any newspaper at that time pub- lished iu the county of Salt Lake, Utah Terri-! Terri-! tory, and out of the proceeds of such sale, first j to pay the cost of advertising, selling and conveying con-veying said premises, including a reasonable commission to the trustee for his ervices and a ! reasonable attorney's fee and all other expenses of this trust. Secondly, to pay to the holder of said promis-! promis-! sory note snch sums as he may have paid for taxes or assessment on said premises, or to ex-1 ex-1 tinguish any outstanding title or liens therein, j Thirdly, to pay the full amount of said promis-! promis-! sory note, together with interest thereon, and, j whereas, the snid Leonard S. Osgood and Emma I L. Osgood have not paid said promissory note, nor any part thereof, and the same is past due and payable - Now, therefore, in consideration of the premises, and of the power ves'ed in me hv said Trust Deed and by request of the legal holder of said promissory note, I will, on Monday, thetdthj Thirteenth day of June, 189:2, at 1 o'clock p.m, on said day, at und upon said "No-You-Don't" Mining cairn, in the said County of Tooeie, sell said described property to the highest bidder for cash, or so much thereof as may pay said note and interest thereon, trustee s and attorney' fees and the expenses of said trust as provided ia raid trust deed.
