Patrick Rash Sues the Blue Jay Mining Company Two More Actions on Promissory Notes. A novel action has just been brought in the Third District court, the plaintiff being Henry Carrigan, and the defendants Treasurer Treas-urer ihike and Salt Lake City. la his complaint com-plaint Mr. Carrigan sets up that in 1S0, V. A. Stanton was appointed the chief of the lire department for the term of two years, and his salary was fixed at $lbO0 a year, payable monthly; that on May (ith, 18'.r2, the city council passed another ordinance, whereby the city, contrary to the statutes, increased the salary of Mr. Stanton Stan-ton to $2000 a year, and in like manner in-ereased in-ereased the salaries of other officers; that Unless restrained Mr. Duke and the city will pay out of the treasury the said illegal in-cr in-cr ;i-e of sah.ry , and thereby waste and dissipate the funds of the city, and the burdens bur-dens of taxation of the plaintiff and others will be greatly increased. The plaintiff fur-tK fur-tK r sets up that he has no plain and speedy remedy in the ordinary course of law, therefore he asks that the defendants and their agents be perpetually enjoined from paying the increase of salaries, as provided in the ordinance above referred to, and that pending the litigation, a temporary injunc- lion be issued. A temporary injunction has been issued and the hearing set for June 14. Judge Powers and Oden Hiles are the plaintiff's attorneys. Against the Blue Jay. Patrick Rush will this afternoon bring suit against the Blue Jay Consolidated Mining Min-ing company. In his complaint he will set up the contract between Wood's and Mor-risey Mor-risey and the promoters of the company, by viltich the latter agreed to pay Wood's $15,-000 $15,-000 and to issue to them one-fourth of the capital stock. The. plaintiff has purchased 20.000 of the 50.000 shares which were to have been issued to Morrisey, and he brings this action to compel the company to issue tl e stock, to pay Wood's mortgage of $15,-000 $15,-000 and to make the improvements on the property as they agreed to do at the time the company was organized. Thomas Kane and C. Stewart Beattie are the plaintiff's attorneys. A Damago Suit. Martin Larson, administrator of the estate of James Larsen, this afternoon brought suit against the Utah Forwarding company. The plaintiff alleges that on April 1st last, James Larsen was employed by the defendant defend-ant at the Iron mine, in Tintic district, and while working in a cut, a cave occurred and Larsen was instantly killed. Plaintiff alleges al-leges that the accident was due entirely to the negligence of the defendant, and he claims damages in the sum of $20,000. W. C. Hall is the plaintiff's attorney. On Promissory Notes. Chas. W. Green has brought suit against O. T. Carlson to recover $1950 alleged to be due on a promissory note, and for the foreclosure fore-closure of a mortgage given as security for the same. Wm. Meikle has brought suit against J. M W. Carrigan and wife to recover $5000 al-P al-P leged to be due on a promissory note. Frank Pierce is the attorney for the plain-1 plain-1 tiff's in both cases. |
