I. dimming his wife, on the 44th day of April, 1KH executed and delivered to the Salt Lake Valley Loan and Trust Company their certain cer-tain prouiissorv note for the sum of 4750. payable pay-able on the 44tli day of Octoler, lS'.Pl, with interest thereon at the rate of 8 per cent, per annum from date until maturity, payable quarter-annually, according ac-cording to the tenor and etfect of two interest coupons each for the'sum of $.'. attached to said principal note, and with interest after maturity upon all sums remaining unpaid at the rate of 14 per cent, per annum until fully paid : and. 1 Whereas, to secure the payment of said note ac- j , cording to its true tenor and effect, the said Mar- ; low L. dimming and C. 1. dimming, his wife, on said April 44th, 1W1, executed and delivered to j O. Salisbury and Simon Bamberger in trtist, the following descrilied premises situate in Salt Lake County, i'tah Territory, to wit: "All of Lot Nineteen (1H) and Twenty (3) iu Block One (1) of Kice A fielder' First Addition. Said Addition being a subdivision of Lots Fourteen Four-teen (H) and Fifteen 1.M of Block Thirteen (13), Five Acre Plat "A" Big Field Survey," which said deed was duly filed tor record in the ofihe of the County Recorder of Salt Lake County. I'tah Territory, 'on the said 44th day of April. Inland Inl-and recorded in book "HA" of the mortgage records of said office, on page 4:t; and, W hereas, said deed provides, among other things, that should default be made in the pay nient of said note according to its true tenor and effect, said trustees, or either of them, or in case of their refusal to act or disability in any wise, the then ac ting Sheriff of said County, at the re, quest of the legal ladder of said note, may proceed pro-ceed to sell the property in said deed and hereinbefore herein-before described. at public vendue to the highest bidder, at the front door of the Court House in the County of Salt Lake, Territory of Utah, for cash, first giving thirty days' public notice of the time, terms and place of sale, and description of the property to lie sold, by advertisement in some newspaper printed and published in Salt Lake County, I'tah; and Whereas, Said maker of said notes have ntterly failed and refused to pay the same or any portion thereof, and the same is now wholly due and unpaid; un-paid; and Whereas, said trustees first named herein are iiiiyl'le to act, and have refused to act, now, there-tore', there-tore', pursuant to the power in me vested by said trust deed, and at the request of the First National Na-tional Bank of Deadwood, of the City of fleadwood, State of South Dakota, the present and legal holder of aaid note, 1, A. J. Burt, sheriff of Salt Lake County, I'tah Territory, will, at the front door of the Court House of Salt Lake County, in the City of Salt Lake, Utah Territory, Ter-ritory, on the 19th day of Decemler, 1RH1, between the hours of 12 o'clock m. and 2 o'clock p. m. of said day, sell at public: vendue for cash, the premises hereinlwfore and In said deed described, de-scribed, to satisfy said note and interest, and the costs of executing this trust, including ten per cent attorneys fees as stipulated for in said trust deed.
