Confirming the assessment of 'taxes for paving, curbing and guttering on both sides of Commercial street. Prescribing and defining the duties of the board of public works of Salt Lake city. An ordinance amending sections 8 and 9 of an ordinance rising and regu-lating the use of sewers, private drains, cesspools, plumbingand drainage works in Salt Lake. An amendment to the "cattle" ordi-nance was passed. The ordinance pro-vides that no person shall keep any swine nor not more than three cows in the limits bounded on the north by Seventh North, on the south by Ninth South, on the east by the reservation, on the west by Sixth West street. P. & H, Co is 00 Total aj.51 It must be assumed that the city council which enacted the revised ordi-nances used apt words to express their meaning; therefore the use of the word "determine" must have been used in the sense that after the matter was once determined it was fixed and ended. The definition of the word "determine" would imply this construction. Among the definitions are: "To set bounds to," "to fix determination of," "to limit," "to bound," "to bring an end to," "to finish." to fix power or character of,"-"t- prescribe impera-tively," "to ' assert definitely," "to bring to a conclusion," "to settle by au-thoritative or judicial sentence," "to come to a decision," "to conclude." To assume that the rate per cent could be changed after once being de-termined would imply that the rate could be either lowered or raised. To raise the rate would perhaps- - invalidate the whole tax, and, by parity of reason, to lower it might have the same ef-fect. Upon the whole question I am of the opinion that the council, having once exercised their power at the appointed time, and in the manner prescribed by the ordinances, and having determined the rate per cent of the city tax for the current year, that they have lio power now to change the same. ,. FOR CEMENT SIDEWALKS. City Engineer Doremus presented specifications for cement sidewalks on Commercial street. The specifications provide that the pavements are to be made of the best English-Portlan- d ce-ment, and to have a uniform thickness of six inches. The width is to be such asi'will cover the entire surface of the walk from the curb to the building line. The substratum is to be of concrete five inches thick, of which one part shall be cement, two parts sand, and four parts fragments of stone, furnace slag, hard burned brick or clean gravel. The en-gineer also presented specifications for rock asphalt pavement, the name given to Utah asphalt. The engineer's report also estimated the cost of grading, curbing and gutter-ing and paving with asphalt First East Street between South Temple and Third South at $115,827, of which the city's proportion would be $23,485 and the abutters' proportion $92,343. The eugineer stated that provision must be made for irrigation water, which he recommended be carried iu open conduits instead of covered pipes. The construction of these conduits should be such as to dispose of storm water also. The matter was referred to the committee on streets. COMMITTEE REPORTS. The committee on waterworks re-ported in favor of purchasing a wagon for the superintendent of waterworks. Adopted. The committee on municipal laws re-ported ordinances passed and enrolled. Filed Judge Laney presented a report of business transacted in the police court during the month of August.
