In a law suit, to prevent the city from applying ap-plying what is known as the Franklin fund to school purposes. Under his will lienjamin Franklin bequeathed in trust to the cities of Philadelphia and Hoston .C 10(H) each to bo invested in the form of loans at 5 per cont to young married artificers under the ago of M years. At the end of one hundred years the fund .amounted to A'Ull.OOO. Of this i'lOO.OOO is to be devoted to municipal muni-cipal improvements and tlm balance to be reinvested for itnol hor hundred year, fjjq'ho suit now commenced has for its object the distribution of this fund to the heirs of Franklin. It is estimated that over liflv of these heirs are in the cit v. The suit will be first decided hern before any Bteps are taken to secure the funds in Hoston. Tho contest is based on the perpetuities of. common law. It is also claimed that tin' purpose of the testator has not been consummated owing ow-ing to the apathy aud negligence of the trustees. |
