Show STATES REPLY IN TAX CASES dan B shields of salt lake attorney general for utah early in the month filed answer to the complaint of the utah copper company and nineteen other mining companies which are seeking an order or of court restraining the state treasurer from disposing of the properties of the various companies to satisfy the occupation mine tax plus a 3 per cent of the net earnings ear ninga state treasurer daniel 0 larsen asked that the proceedings 6 be dismissed and in a separate motion demanded dismissal of the suits brought on behalf of the boid chain bullion coalition american fuel company cameron coal company scofield coal company and the western utah copper company on the ground that the amounts involved in the aggregate 6 tl with all of these companies does not exceed and the matter is not within the tion of the united states court it is denied in the answer that the constitutional rights of the utah copper company or any of the companies under the fourteenth amendment to the constitution of the united states have been abridged and denial is made that the law under which the tax was levied was passed either in an irregular manner or outside the legal time within which the legislature was empowered to enact such a law it is also alleged that the law under which the tax was imposed Is not in violation of the provisions of the state constitution designed for the purpose of the assessment of an occupational tax it is also maintained by the state treasurer that the tax as assessed against the mining companies is not more than the 4 mills provided by the constitution implication is made in the answer that the mining companies of utah have been specially favored and that they have never been required to play pay a tax in proportion to the tax paid by other industries and corporations po and that their properties have been assessed at a less rate than other classes of property the state treasurer alleges 6 that a speedy and adequate remedy rem edy is at the command of the minin mining companies for any injuries which may be sustained by them in event that the treasurer is permitted to proceed with the alleged legal sale of the properties to satisfy the taxes as the state of utah is in position to satisfy any judgments D which may be procured against it the petition is made that the temporary restraining order be dissolved and that the as state tre treasurer u be allowed to proceed with the collection of the taxes |
