Show CHURCH COURT TRIAL APPEALED J S Richards Dissatisfied ith Arbitrators Verdict for President Smith CARRIED UP BY AGREEMENT PLAINTIFF NT I FF CLAI CLAIMS MS DEFENDANT OW OWES ES a The Supreme court will have the op opportunity opportunity of listening to the two to sides of a dispute between Joseph S Rich Richards Richards ards plaintiff and Joseph F Smith for the Church of Je Jesus Jesus sus Christ of Saints which has bas been fought out in the church courts and later in court and which is now referred to the Su Supreme Supreme preme court by agreement In the District court yesterday a mo me tion for a new trial brought by the plaintiff was submitted and overruled by agreement in order that the matter might be appealed to the Supreme court Original Suit Is Ancient The original suit was filed Aug 6 1892 in which Richards the plaintiff al alleged a that the suit was to settle a con controversy in which he claimed that the defendant President Smith was in indebted to him in the sum of for not carrying out an agreement be between between tween hIm and the late Bishop Edward Hunter in the matter of the purchase and sale of certain realty Referred to Church Court The dispute was originally referred to a board of arbitration consisting o four members who were to select a fifth The four members two of which were c chosen osen by plaintiff and two by bythe bythe the defendant did not select a fifth member agreeing that in the event they could not agree upon a verdict the fifth member should be selected The board of arbitration rendered a verdict against the plaIntiff stating that there was no cause for the filing of the action The matter was taken to the Dis District District court in order to be made a mat matter matter ter of legal record and the action of the board or of arbitration was upheld by bythe bythe the District court Judge Hall presiding presiding ing The plaintiff filed a motion for new I trial which was overruled yesterday by agreement In order that an appeal might be perfected |
