Bo it ordained by the City Council of L ike city, that the Water-work constructed by tho Corporation to Biipply S.ilt Lake city with wiiter from City Creek Cuiion, shall be designated and known as the Salt Lake City Water works; they shall bo the property of said city, and shall be under the sole and exclusive control of the City Council, who may from time to time direct tlio construction construc-tion of such reservoirs, witter taukd, water miUDs, servico pipes and tire hydrants as the necessities of the inhabitants in-habitants of the city may require. The City Council shall also appoint a Superintendent of Water-worts, nu Assessor of water rates, and suoh other officers as may bo necessary to carry on the works. All otticra so appointed- shall hold oflico during the pleasure of said Council. Sice. li. The Superintendent of Water-works shall, uuder tho direction direc-tion of the Citv Council, have charge of the reservoirs, water tanks, water main s, Gro hydrants, and all the machinery ma-chinery and appurtenances appertaining apper-taining to the Water works. He i hall have the direction of the laying of water mains, tha putting in of service ser-vice pipes, and tho regulation of tho water supply to firo hydrants and to ail consumers. Sid Water Superintendent, Superin-tendent, before entering upon the duties of his oilice, shall take an oath ofofliceand give bonds, with approved ap-proved security, to S.ilt Lake city, in the penal sum of $0,000, conditioned for the faithful performance of his duties. He shall report to the Cily Council quarterly, or oftener if required, re-quired, his doings iw Superintendent, the condition of the Water-works, and mako such suggestious as the nature ot the service may require. Sec. U. A", hydrants shall be under the control of, and shall be kept iu repair by the Superintendent of the Water-works, and in case of fire or fires the Fire Department and such others as the Cily Council shall authorize, shall have free access to said hydrants. No other person shall open or operate any fire hydrant, or attempt to draw water therefrom. Sec. -1. Any person who shall wilfully" wil-fully" or carelessly 'run a vehicle against a fire hydrant, or otherwise wilfully or carelessly injure the same, or draw, or attempt to draw water therefrom, shall be subject to a fine of not exceeding one hundred dollars, and be liable for all damages done to said hydrant. Sho. 5. Wrenches for fire hydrants shall be furnished by order of the City Council to the Fire Department, for-their use, and to such other persons per-sons as may bo deemed proper by the Council, and any officer or member ol the Fire Department, or other per-ton per-ton having charge of one or more of aid wrenches, who shall permit the same to be taken from their place of deposit, or to be used for any other purposes than thoso authorize! by the City Council, shall be liable to a fine of not exceeding fifty dollars lor each flense. - - - t , Bza 6. When application is made by a tenant, it must be accompanied by the signature of the owner of the building or grounds consenting to and authorizing the introduction of water into such premises, and expressly ex-pressly agreeing to tho rules and regulations regu-lations embodied in the application aud to the provisions ,of this ordinance. ordi-nance. ; SecTS. If any water consumer shall permit any person from other premises, or any unauthorized person, K use or obtatu water from said consumer's con-sumer's premises or water fixtures, whether insido or outside of his building, build-ing, the supply of water may be cut o9 and the amount paid forfeited. Sec. 11. Sec. 14. If any person, after the water has been turned oil from his premises, on account of non-payment of dues, or violation of the rules and regulations pertaining to the water supply, shall turn tho water on again, or use, or allow the water to he used without authority, he shall be fined not exceeding fifty dollars for each offense. - 6ec: 15. Fountains and sprinklers for lawns, gaulens, yards or sidewalks side-walks shall not bo operated during a fire. A'o fouutniu attachment shull be greater than half an inch in dmiA otcr. Sprinklers for Uwns. gardens, gar-dens, yards and sidewalks must be used only for the purposed expressed in tho license; and no sprinkler shall be used for sprinkling the street outside out-side of tho sidewalk, unless such privilege is iucludcd in thn license and paid for accordingly. .Sidewalks, windows and fronts shall no, be sprinkled except between the hours ol 0 and a.m., 1 and 2, and ti and S p.m. No nozzle forepriukhng shall be larger tjan one-fourth inch in diameter, and no license for a sprinkler shall be issued except in connection with other water service. Sec. 17. Sprinkling wagons aud wagons for the delivery or sale of water must be filled from hydrants erected for that purpose, ami shall be regulated and controlled by the superintendent. super-intendent. Sec. 21. The City Corporation shall not be held liable for damage to any consumer by reason of a stoppage i or interruption of his water supply, caused by scarcity of watsr, accidents to the works or mains, alterations, additions, repairs or other unavoidable unavoid-able cause, beyond a pro rata reduction reduc-tion on his license duriog such stop pace. Sec. 22. No telegraph post, hitching hitch-ing or other post shall be pul down or set within four feet of any water ser vice pipe, nor withiu six feet of any main pipe, except on a wrilten permit per-mit from the Superintendent. Sc. 23. Wherever . the water mains are laid, no person shall be j allowed to convey the waters of- City Creek from any ditch or plce by private pipes for fountains, iiiechaui cal or other purposes, except the ordinary irrigation of. lots, under direction of the Water master, nor rhall said waters be hereafter diverted from tiie ordinary irrigation difches for the supply ol steam boilers or oilier mechanism, and all resolutions, ordinances and permits allowing any person to convey Ihe waters ol City Creek, or any part thereof from the ordinary ditches by pipes lor any use or purpose whatever, wherever the water mains are laid, arc hereby repealed. re-pealed. - - Sec. 24. It shall be the duty of the Assessor of water rates to ascertain ascer-tain by measurement, cr estimate, as near as practicable, the amount of water used by each water taker; aud he shall mako an equitable assessment assess-ment thereon, based upon the rate of ten cents for each one thousand gallons; gal-lons; and no persons Bhall hare tho water conducted to their premises without paying five dollars per annum. an-num. If they consume more than tho worth of rive dollars they shall pay at the above mentioned rates. Said assessment shall be made for a term, commencing. -from the time the water is turned on to tho "promises and ending on the 31st dayot March, 1S77, and thenceforth quarterly. The Assessor shall make prompt returns of his doings to tho City Recorder, who shall charge to each person the amount assessed against him, which amount shall be payable on demand and' bo collected and paid into the City Treasury in the same manner as license fees are collected aud paid in. Sec. 23. Any person violating any of the provisions of this ordinance, where tho penalty is not herein other- wise provided, shall, on conviction, be liable to a fine not exceeding fifty ; dollars lor each oflense. j Sec. 26; Nothing herein contained shall prohibit the City Council Jrom amending, alteiing or adding to the provisions of this ordinance in relation rela-tion to the water supply or the rules aud regulations which may be adopted adop-ted in conformity therewith; Provided, that no alteration in water rates shall apply to any license issued or contract made with a consumer under this ordinance, or-dinance, until after the expiration of such license or contract.
