Show Tiie t Uiraso Election Colviu ltesculeu. Chicago, 5. In the circuit court this morning, the five judges sitting in banco, gave an adverse opinion inlh nayoralty case of Colvin cs. Hoyue. Tho majority of the judges, McAllister, McAllis-ter, Williams and Rogers, decide that since the city council neglected to call an election for mayor at the time when Mr. Colvin's term expired, and since such a call is necessary to secure a valid election, that the voted recently re-cently cast for Mr. Hoyue are nugatory, nuga-tory, and that Mr. Colviu holds bis otiice unlil an electiou is duly called by the council. Judges Farewell and Booth read dissenting opinions to the eflect that the f nil-ire of the council to perform its duty does not invalidate the votes cast, because t'je law is mandatory, and an election may legally be held, notwithstanding Bitch derilicliou on the part of the council. |
