Show Tbe Mariposa Kelly Suit. New York, 16. The real facts of the pending suit between Eugene Kelly and the Mariposa mining company com-pany are briefly these: Kelly proceeded pro-ceeded to foreclose the mortgage held by him on tbe Mariposa mining property; F. B. Wallace, a heavy stockholder, claiming for himself and others that the mortgage was fraudulent fraudu-lent and that all just claims against the company were paid, brought suit here against Kelly and company to compel them to surrender said mortgage upon the above stated grounds; aljo to recover $300,000 claimed to be due to the company by the defendants, and $1,000,000 damages, dam-ages, which the company and stockholders stock-holders claim to have suffered ihreugh the illegal acta of the defendants. Judge Dykmi;n, on motion ot ex- T.,Ho lrnlloprrtii fiir tho nlaintiffr. granted a temporary injunction restraining re-straining Kelly and company from continuing their foreclosure suit in California, and interfering with the estate or possession thereof by the Mariposa Land &. Mining company, ;or i:s efficers. The argument upon the question of making the injunction permanent, was yesterday postponed to Monday next, at toe request of Kelly's attorney. |
